Paul Elliott has poked his head out of his hole claiming that he is the true owner of East Street Investments (ESI). Tahnoon Nimer has disappeared off the side of the planet as phantasm’s have a habit of doing and Elliott has emerged victorious of owning a company that owns nothing except some really negative Google searches.
Should we be worried? CAST’s post says we shouldn’t and I agree. Sandgaard has been sat in his office in Colorado waiting for this email to drop in his inbox.
Elliott’s letter, because that’s all it is, telling Sangaard to leave immediately is a last gasp grab for some dirty cash, the only currency Elliott knows.
It would tell me that Sandgaard never deemed Elliott worthy of getting paid when he acquired the club, and Elliott feels he somehow deserves something. He surely doesn’t want to own the club.
Next, and we may never know, does Sandgaard send Elliott a cheque, does he engage law firm Freshfields to ruin him, because they would, or possibly the Dane simply ignores him, because you know full well that the EFL will.
One thing is certain we really could do without this playing out in big lights again, none of us especially Lee Bowyer want the distraction.
Should we offer Mr Elliot any sound advice regarding his hole ?

And may I suggest those careful directions exclude any lubrication.
My guess is Thomas will ignore him…Why would Thomas waste money re-engaging Freshfields to crush Elliot?
Satisfying though it would be, it might look like Elliot had a case which he clearly hasn’t otherwise Freshfields would have advised Thomas differently at the start of the acquisition.
The only type of order that should worry TS (and therefore us) is a court order. This is a long, long way from having any legal authority and if Elliott does try and get a court order for TS to vacate the premises then TS will fight it.Unlike the last fiasco of a court battle he can expect TS to be better armed and will ask some questions such as why didn’t you complete the takeover when you had the opportunity? And why did you fail the EFL’s OAD Test? And if there really was just an admin error why was it not corrected followed by what makes you think you’ll pass it this time around?
ESI is basically a shell company with no assets and a name that is tarnished. Nimer didn’t bother figting any kind of takeover of it because it’s not worth spending money on.It’s amusing in a way that Elliott and farnell have spent all this money on something with no value, given their intention was to rip off the club that’s somewhat ironic.
In any case Elliott’s legal battle to get back any money he spent while he was CEO should really be with Nimer and not TS. The latter had nothing to do with CAFC/ESI at the time he owned the club.

The reason is that TS was negotiating with Nimer as he owned the club/assets. Elliott never had any legal control of anything so there was nothing to buy off him. At best he could have paid him something to go away but that would be a waste of money in my opinion. TS therefore owes Elliott nothing.
